Gravel mine applicants sue Taghkanic over delay

TAGHKANIC–Zoning Board of Appeals Chairman Jim Romaine announced at the May 10 ZBA meeting, that both the ZBA and the Town Board are defendants in an civil suit filed by Berry Pond LLC, the entity seeking a permit from the ZBA to start a gravel mine on Livingston Road.

The plaintiffs in what is called an Article 78 action, Allyson Bennett and Barry Pond, LLC, received a permit from the state Department of Environmental Conservation, but still need one from the ZBA to commence mining gravel at the site. Their progress was halted this spring, when the Town Board voted in favor of a nine-month moratorium that curtails the issuing of mining permits while a zoning commission sorts out existing ambiguities in town zoning code.
