HUDSON–The county District Attorney’s Office has asked the state Supreme Court to extend Pegeen Mulligan-Moore’s term in prison until she has paid back the $494,000 she still owes the Towns of Kinderhook and Greenport and Hartford Fire Insurance Company and Travelers Insurance Company.
Ms. Mulligan-Moore was sentenced in June of 2011 to three to nine years in prison for embezzling over $500,000 from the towns while she was a clerk for the municipalities, first in Kinderhook then Greenport.
At the time of sentencing Judge Jonathan Nichols also imposed a 5% surcharge, bringing the total of her restitution to $556,560.86.
Last December Ms. Mulligan-Moore made one payment of $61,764.16. But on June 21, 2011, according to court documents, Ms. Mulligan-Moore’s attorney, Andrew Safranko of O’Conner and Aronowitz in Albany, said, “With respect to the dollar figures and restitution, judge, we have alluded to, we believe within the next couple of weeks there will be approximately $125,000 available.” She went on to state that she expected to have $62,000 in an escrow account, and other $60,000 within the next few weeks of the June date. No additional second payment has been made, according to court records.
Town Supervisor Pat Grattan talked about the reimbursement from Ms. Mulligan-Moore at a town meeting in February. He said the town had received just under $50,000 and promised that Kinderhook would receive $100,000 still owed.
Greenport is owed a balance of more than $20,000.
In the court papers signed by Judge Nichols in his capacity as an acting state Supreme Court judge, the DA’s Office requests a modification of the restitution orders to extend Ms. Mulligan-Moore’s prison term until all the money is paid in full and order that she be compelled to complete an Affidavit of Financial Information. She is scheduled to appear in court in Columbia County May 15. She is currently being held at Beacon Correction Facility.
The DA’s office declined to comment on the case and Ms. Moore’s attorney could not be reached for comment.
